Conditional Use Application

Some types of development or land uses may be allowed in the RM of Headingley, but only after review and approval by Council. These are called Conditional Uses.

A Conditional Use is generally a use that may be appropriate in a certain area, but requires a public hearing so Council can consider the proposal, hear from nearby property owners, and decide whether any conditions are needed to reduce potential impacts.

Do I Need a Conditional Use?

You may need a Conditional Use approval if your proposed use is listed as a Conditional Use in the RM of Headingley Zoning By-law.

Common examples may include: secondary suites, home-based businesses, bed and breakfasts, automotive repair shops, drive-throughs, storage compounds, schools, places of worship, community clubs, and public utilities.

How to Apply

A complete application must include:

  • Completed Conditional Use Application Form

  • Detailed site plan

  • Detailed letter of intent

  • Status of Title, dated within 30 days

  • Application fee: $700.00

Incomplete applications may be delayed or returned for revision.

Public Hearing Process

All Conditional Use applications require a public hearing.

As part of the public hearing process, notice is mailed to all property owners within 100 meters of the subject property. Notice is also posted at the Municipal Office, Headingley Community Centre, and Municipal Library.

At the public hearing, Council may consider:

  • Compatibility with surrounding land uses

  • Potential impacts on neighbouring properties

  • Site layout, access, parking, servicing, drainage, and other planning matters

  • Comments from nearby property owners or affected agencies

Council may approve the application, approve it with conditions, or deny the application. Conditional Use decisions are not appealable.

Applications must be submitted at least 21 days before the scheduled public hearing. Public hearings are generally held on the 2nd and 4th Tuesday of each month.
